Citizenship Amendment Act, 2019 purely Legal and Constitutional – Satya Pal Jain

Chandigarh December 28, 2019. Sh. Satya Pal Jain, Ex. BJP MP, Additional Solicitor General of India & a member of the National Executive Committee of the BJP has said that recently enacted Citizenship Amendment Act, 2019 is a perfectly valid and is absolutely Constitutional, which has been passed by the Parliament in exercise of the powers conferred by Article 11 of the Constitution of India. He said that he is very confident that this amendment will withstands the test of Judicial Review in any Court of law.

            Mr. Jain was addressing a press conference in Chandigarh today in favour of the CAA, as a part of the nationwide awareness campaign, started by the BJP in favour of the CAA.

           Severely criticizing the Congress and other opposition parties for making utterly false and absolutely baseless assertion about the Act, Mr. Jain said that this Act does not take away any right of any citizen of the 130 crore population of India. He said that because of this Act, neither the citizenship of any Indian citizen, may be of any religion, can be take away or will be take away at any time.

           He said that under Article 29 and 30 of the Constitution of India, Indian Constitution gave rights to the minorities in India to manage and preserve their religion, culture etc. etc., which has been upheld by the Hon’ble Courts in a number of judgments. He said that by way of the CAA, the minorities of the neighboring countries, i.e. Afganistan, Pakistan and Bangladesh, have also been given similar rights in the matter of acquiring citizenship of the country. He said that for the purpose of acquiring citizenship, earlier a migrant had to wait for 11 years before he could become a citizen of India, but by the present amendment this period of 11 years has been reduced to 5 years. Similarly, the proviso which has been added now makes it clear that the people belonging to minorities coming from Afganistan, Pakistan and Bangladesh will not be treated as illegal intruders.

            He said that the manner in which the minorities, including Hindu, Sikh, Christian, Parsi, Jain etc., were persecuted in those 3 countries, they had no other option except to rush to India for shelter. He said that the present Central Government led by Prime Minister Sh. Narendra Modi has given shelter to them and by granting citizenship to those people, they have been allowed to live for the rest of their lives like respectable citizens of the country.

           Mr. Jain said that the statements issued by various Chief Ministers, including Capt. Amrinder Singh and Smt. Mamta Banerjee, that they will not allow this amendment to be implemented in their States, are perverse in nature because the State Governments have no role in the implementation of the CAA because it is a Central Act. He said that all the State Governments are bound to honour and respect the laws enacted by the Parliament of India and, in case they flout it, it is the insult and disrespect to the rule of law, Constitution of India and Democratic polity of the country.

           Mr. Jain said that the Congress leaders like Smt. Priyanka Gandhi and Sh. Rahul Gandhi have been frustrated in their political lives to such an extent that they have started making absolutely false statements and using derogatory and foul language against the Hon’ble Prime Minister of India and other leaders of the BJP. He said that the people of this country will never forgive the Congress for betraying the interests of the minority community from abroad and also for carrying out false propaganda against the present Centre Government.

            Mr. Jain said that in case the opposition feels that the amendment carried out by Parliament in Citizenship Act is not valid, they had every right to go to the Supreme Court and challenge the same, instead of resorting to violence and protest etc and causing damage to the public property. He said that people of India have understood the evil design of the Congress and will give them a befitting lesson in the days to come. He advised the opposition leaders to first visit the camps of minority migrants of these 3 countries in various parts of India, study the pitiable conditions under which they are living and then make any statement about them.
