disqualify Parliamentary Secys

SHIMLA, NOVEMBER 5: The BJP today
filed a petition before the Governor seeking disqualification of the 12
Chief Parliamentary Secretaries (CPS) and four Parliamentary Secretaries
(PS) for holding the post which had already been termed illegal by the
high court.
The
72-page petition was filed by the chief whip of the BJP in the
Assembly, Mr Ravinder Ravi, under Article 192 of the Constitution.
They have sought the disqualification of all 12 CPS and four PS for
holding the post. Former Chief Minister, Prem Kumar Dhumal, Convener
of the National Legal Cell of the BJP Satpal Jain and other
BJP leaders met Governor V.S. Kokje in this regard.

observed the Maharishi Valmikli Jayanti at Chandigarh. Several leaders
participated and spoke on the life of the seer.
Former MP Satya Pal Jain said," The message of Maharishi
Valmiki is not confined to any particular religion, place or section of
the people, but it is for the entire mankind. Thus, the sacred name and
message of Valmiki towards humanity shall remain till eternity."
BJP SC Morcha President Sachin Lohatiya said that it was a matter
of great regret that even after a long span of 55 years of independence,
the Congress and its allies were looking at Dalits as 'vote bank' but
have done nothing for them.
While addressing the huge gathering he further said , " All the
facilities and benefits, which were to be given to the Dalits, were
being enjoyed by these parties for their own benefit, as a result of
which the Dalits were forced to live a poor and miserable life."

today criticised Congress MP Rahul Gandhi, who recently visited the city
as a member of the Parliamentary Standing Committee on Home Affairs, for

delegations.
Addressing a press conference in the city today, Jain said Rahul Gandhi
had come here on an official visit as a member of the committee and he
should have met the delegations and heard their problems.
Parliamentary Secretaries' case: notice to Punjab

Chandigarh, September 15: The Punjab
and Haryana High Court today issued notice of motion for October 27 on
the petition filed by Mr Anter Singh Brar, a BJP leader, seeking
directions to the Punjab Government to remove Parliamentary Secretaries.
Taking up the petition, the Division Bench comprising Chief Justice
Mr Justice D.K. Jain and Mr Justice Hemant Gupta also issued notice to
the Punjab Chief Minister and the Parliamentary Secretaries.
The Bench also took on record the recent judgement of the Himachal
Pradesh High Court, quashing the appointment of the Parliamentary
Secretaries.
During hearing, Senior Advocate Satya Pal Jain, counsel for
the petitioner, stated that the appointment of Parliamentary Secretaries
a drain on the exchequer and was illegal as no such post existed under
the Constitution. He said though the 91st amendment to the Constitution
restricted the number of ministers in Punjab to not more than 18, the
Chief Minister, because of political reasons, appointed 12 MLAs as
Parliamentary Secretaries all of whom have been given rank of Deputy
Minister. This way, crores of rupees were being wasted, Mr Jain
asserted.
He also maintained that there was no legal sanction to the post. Mr
Jain also quoted the Himachal Pradesh High Court judgement in the
matter.
Hearing will now resume on October 27.

The appointment and continuance of three chief parliamentary
secretaries and nine parliamentary secretaries in Punjab has been
challenged in the Punjab and Haryana High Court as a follow-up to the
quashing of similar appointments in neighbouring Himachal Pradesh by the
Shimla-based High Court recently.
A public interest litigation (PIL) petition in this regard filed by
advocate Antar Singh Brar a member of the legal cell of the Bharatiya
Janata Party, came up for consideration before the division bench of
Chief Justice D K Jain and Justice Hemant Gupta.

Jain the counsel for the petitioner to place a copy of the order
passed by the division bench of the Himachal Pradesh High Court

High Court today quashed the appointment of 12 chief parliamentary
secretaries and parliamentary secretaries. Declaring the appointments
illegal and unconstitutional, the court said their continuance in office
was impermissible under the law.
The 12 secretaries resigned from their
office soon afterwards and also returned their official cars. ...

quashed the appointment of eight Chief Parliamentary Secretaries and
four Parliamentary Secretaries with immediate effect and ruled that the
Chief Minister, Mr Virbhadra Singh, had no powers to make such
appointments. The court also directed the Chief Secretary to see to it
that the order was implemented forthwith. ...

In a statement, Mr. Jain said the Court had also ruled that such
schools charge only "reasonable fee" from the students. He said he was
"shocked" to read a statement by the Punjab Governor and UT
Administrator, S.F. Rodrigues, in which he had directed that 15 per cent
seats be reserved for poor students in private schools.
Mr. Jain said the Chandigarh Administration officials were very
well aware that on February 14, 2005, a Division Bench of the Punjab and
Haryana High Court had issued clear directions to them to reserve 25 per
cent seats for poor students and to fix the fee to be charged from all
students. Following the court order he said he himself led a BJP
delegation to the Administrator who had assured that the judgment would

The Chandigarh unit of the BJP held a demonstration
against the UPA Government at the Centre, UT Administration and the
local Congress party MP for their ‘‘anti-people’’ policies on Friday.
They were protesting the low water pressure in the city. The activists
were carrying earthen pitchers and empty buckets while raising slogans
against the Congress party on the Municipal Corporation premises. They
also broke the pitchers and buckets at the end of the protest. Ex-MP
Satya Pal Jain said that the Congress has committed a breach of
trust by not fulfilling its promises. The MC’s claim of supplying water
thrice a day has also not been fulfilled, he alleged. Jain also
complained about the poor sanitary condition in the city.

of the BJP today organised a protest rally at the roundabout of Sectors
55 and 62 against the alleged anti-people policies of the Congress-led
UPA government at the Centre and against local MP Pawan Kumar Bansal.
Addressing the gathering, former MP Satya Pal Jain said the
price of daily-use items had gone up many times during the last 10
months. The law and order situation during the Congress rule had
worsened and no step had been taken to generate employment as it
promised before the Lok Sabha election, he added.
The party workers also raised slogans against Pawan Kumar Bansal
for not allowing SCs to show their resentment during the Prime Minister

knowledge of the final plan. The officials said the original plan

slum-dwellers to different areas in the periphery and there was no plan
